Unpaid rent?

I have not made my rent payments. How does the collection process proceed? What can the consequences be?

The collection of unpaid rent differs a bit from the usual (learn more about the collection process in the section titled Did you receive mail?) collection process, as if you do not initiate contact and explain your situation by the due date of the first demand for payment letter, the lease agreement may be dissolved.

Therefore, contact the collection agency as soon as possible and agree on paying it off. It is definitely advisable to make the next rent payments to the lessor on time by their due date.

When the collection of unpaid rent payments advances to court, a ruling confirming the obligation to pay the debt is sought from the district court. In conjunction with delivering the subpoena notification, you may also be delivered the dissolution notice of the lease agreement.

The district court ruling will result in a default payment entry in your credit report, which makes obtaining a new lease difficult, for example.

Can I make a payment plan?

Payment plans are not usually agreed on with unpaid rents, but the due date can be postponed. Please do not delay and contact the collection agency that sent the demand for payment and suggest a new due date.

When can the lessor dissolve the lease agreement?

The lessor can dissolve a lease agreement, when the lessee has breached the terms of the lease agreement. These can include, for example, neglecting to pay rent, disruptive lifestyle, or damaging the premises. In these cases, the lessor must provide a written dissolution notice, which must state the grounds and effective date of the dissolution.

The dissolution notice must be delivered to the lessee in a manner that receipt of it can later be proven. A district court subpoena that seeks dissolution of the lease can also serve as the dissolution notice.

What is an eviction?

If the lessee does not follow the lessor’s request to move out of the premises, the enforcement authority will handle the vacating of the premises.

The eviction is based on a district court ruling where the lessee is required to move and deliver possession of the leased unit. If necessary, an eviction ruling can be sought from the court in conjunction with a payment obligation ruling being sought for the unpaid rent. Paying the balance of the unpaid rent does not remove grounds for the eviction. Instead, the lessor can still seek the execution of the eviction, regardless of the payment.

Prior to implementing the eviction, the administrator of the collection proceedings delivers a move notice to the lessee, which states the date the unit must be vacant.
